TERMS AND CONDITIONS OF SALE APPLIES TO UK ONLY

Any statutory consumer rights enjoyed by you are not affected in any way by these terms and conditions of sale.

These terms and conditions will apply when you place your order with us.
1.2
These terms and conditions make repeated use of certain terms which we have defined in condition 12.

Before you place your order, we reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on this website and it is your responsibility to read these terms and conditions on each occasion you use this website.

Please print these terms and conditions and any email we send you for future reference.

2.
SPECIFICATION OF GOODS

2.1
It is your responsibility to provide us with accurate measurements suitable for your requirements. We cannot be held responsible for your inaccurate measurements or any consequences thereof. Information on how to correctly measure fasteners is freely available from the help section of this website.
2.2
All finishes offered by us and shown in graphic form on this website in relation to the goods are typical only the format of markings on fasteners can vary as can the precise depths and profiles of socket recesses. Manufacturers of other non fastener items we offer for sale can vary.
2.3
We go to extremes to make sure exact finishes, shades and degrees of reflectivity of our products are accurately represented but this is not always possible due to variations in certain computer monitors. We will not accept returns because your computer equipment has inaccurately represented such.
2.4
We are happy to offer advice on products, product options and finishes but it is your responsibility to ensure the product or service offered meets your needs.This applies to any advice we offer be it of whatever nature.
2.5
All fastener and bar stock material is procured to the relevant ISO, BS or EN material specification wherever possible from a source offering full traceability. All bar stock for production of nuts and bolts is procured from a BS approved source with certificates of conformity of the material.
All sizes of fasteners are quoted are within the relevant ISO or BS manufacturing tolerance where such a specification exists.

PRICE AND PAYMENT

3.1
The price you pay is the price displayed on this website at the time we receive your order. Any price displayed on this website shall be subject to change at any time; all errors and omissions are excepted.
3.2
All prices are shown in UK £s sterling and include value added tax [where applicable] at the applicable current rate.
3.3
Whilst we try to ensure that all prices on this website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat your order as cancelled.
3.4
Title to any goods shall pass to you on delivery of the goods provided that we have processed and received payment in full for the goods.
3.5
We reserve the right to cancel or refuse any order placed with us without providing any specific reason. Under such circumstances and monies or deposits paid will be immediately refunded in full.

ORDER PROCESS AND CONTRACT FORMATION

4.1
The steps required to create a contract of sale between you and us are as follows:

  1. You will place your order by pressing the order confirmation buttons during the check out process;
  2. We take payment from you at the time you place your order, using the payment option chosen by you during the checkout process. Please note that this payment is not an acceptance by us of your order or evidence of any contract, nor does it imply acceptance of any conditions other than those specified on this page.
  3. Your order is always subject to our acceptance and we reserve the right to refuse to accept any order and will return any monies paid

DELIVERY

5.1
If paying by credit or debit card then delivery of the goods can only be made to the address at which the card is registered.
5.2
Delivery charges and estimated timescales are detailed in this website and when you place your order. We make every effort to deliver your order within the estimated timescales communicated to you and in any event within 30 days of the date of order. However delivery is not the essence of any contract we undertake; in addition postal delays are occasionally inevitable due to unforeseen factors.
5.3
Risk of loss and damage to your order passes to you on the date when the goods are delivered or on the date of first attempted delivery by us.
5.4
Upon delivery if any goods are found to be incomplete, damaged or incorrect then you MUST contact us within five working days of receipt of the goods detailing fully the discrepancy or fault. This clause will not apply if purchasing certain full kit systems from us in which case you will be advised.

All respective manufacturers trademarks and copyrights are acknowledged.

7.
CANCELLATION RIGHTS AND RETURNS

7.0
If you wish to cancel your order:

  1. If your order hasn’t shipped you can notify us by quoting your order number.
  2. If your order has already been dispatched to you, by returning goods to us in accordance with clauses 7.1, 7.2, 7.3 below.

7.1
Where the goods ordered are made to measure [studs, bright polished fasteners, fasteners or material cut to a non standard length, electropolished[except standard/non modified button heads or standard/non modified M10/M12 Socket Caps which are supplied electropolished as standard] , goods ordered as ‘specials’, goods ordered into stock specifically for you] you shall have no right to cancel your order, return the goods [unless incorrectly supplied] or seek any refund of the price paid by you from us. This is because these items are produced to your order on a bespoke basis. Accordingly, pursuant to Regulation 13[1][c] of the Consumer Protection [Distance Selling] Regulations 2000, conditions 7.2, 7.3 & 7.4 shall not apply in this case.
7.2
Where condition 7.1 does not apply, you may cancel your order no later than 7 days after the date of delivery of the goods by delivering a cancellation notice to our returns address us at:

7.3
If you cancel your order:

  1. you must at your own cost and expense, return the goods to us at our returns address detailed in condition 7.2, unless they are not of satisfactory quality, non conformance with the standard quoted in the description of the goods or as described within the meaning of the Sale of Goods Act 1979 in which case we will at our option our option either:
    1. arrange for the goods to be collected from you at our own cost and expense: or
    2. we will reimburse you the reasonable delivery costs incurred by you in returning the goods to us.
  2. you must re-pack and take reasonable care of the goods whilst they are in your possession and if you are returning via royal mail you must obtain a certificate of posting [free of charge] from a post office counter. In the event you fail to do this and Royal Mail fail to deliver the parcel to us you will not be able to claim the value for the lost goods.
  3. The goods returned must be in exactly the same condition as supplied in the original packing and if relevant the immediate wrapping and the complete order [except exclusions detailed in 7.1] must be returned as originally shipped. If goods are not returned in the condition described then 10% restocking and repacking charge will be made in all cases. If any part of the original order is not returned [except exclusions detailed in 7.1] then this will be treated as acceptance of the entire order and you will then have to pay a freight charge to have the items redelivered to you.
  4. within 30 working days of your cancellation of your order, subject to compliance with the preceding three conditions we shall provide you with a refund of the price paid for the goods, less any price paid by you a non standard delivery service, subject to condition 7.4.
  5. If you wish to exchange anything [subject to items excluded in clause 7.1] then this can be done on a part order basis ie the full order does not have to be returned but you will still have to pay the charge for return freight.

7.4
Where the goods are delivered as part of a non standard delivery service, for example a specific haulage company you acknowledge and agree that you have asked us to perform this service before the expiry of the statutory 7 day cooling off period. As such, in the event you subsequently cancel your order, pursuant to Regulation 13[1][a] of the Consumer Protection [Distance Selling] Regulations 2000, you shall have no right to obtain a refund of the price paid for the non standard delivery service.

8.
GUARANTEE

8.1
All of our goods are guaranteed against defects in manufacture but such defects must be reported within five working days of receiving the goods.
8.2
Subject to the previous paragraph, should any defect become apparent, we shall at our expense, replace the defective goods [or any part of them] on a like for like basis, provided that the defect arose from a manufacturing defect. We will not replace goods for any other reason.

9.
GENERAL

9.1
Any contract between you and us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England.
9.2
Our maximum liability to users arising out of or in connection with the goods shall be limited to the replacement value of the product in question no consequential losses arising from use of our products for any purpose shall be entertained. If you are in any doubt whatsoever about the suitability of any of our products use manufacturers original equipment.
9.3
All advice be it technical or otherwise is offered free of charge and in good faith we shall not be held responsible for losses of any description arising from information allegedly supplied by us or misinterpretation by you.
